Order for Oral Examination
As a final option, the client can obtain an Order for Oral Examination of the debtor and may demand that the debtor swears an oath of disclosure of the debtor's assets (Eidesstattliche Versicherung) to find out more about his financial circumstances and get a final statement.
Further assets of the debtor
This requires him to attend the Bailiff and give evidence under examination about his financial circumstances. In practice there can be substantial delays before the debtor is obliged to attend the Bailiff.
The truth of the statements mostly is not investigated. The creditor then receives an official record of the debtor's statement from the Bailiff. This record often helps identify new enforcement possibilities because the debtor must disclose all his assets.
