Avoiding pitfalls in commercial contracts with agents in Germany
Agency Contracts must fit to the business requirements and meet all further legal requirements.
Most of the agency agreements presented in the law office do unfortunately not meet the business and legal requirements, as necessary stipulations are missing and the agreements mostly do no comply with European legal standards.
Companies and agents should therefore avoid these pitfalls as disputes in the case of a finalization of the agency relationships before German courts are being intensively pursued and result in a long duration of litigation.
Legal situation in Germany and Europe
The legal situation is harmonized to a large extent within the European Union but is not totally unified and codified on European or national level.
Therefore an extensive amount of case law has to be considered and the respective rules and regulations in Germany will have to be taken into account carefully.
